MAJOR TRIALS AND CURRENT MATTERS
We have tried dozens of federal and state cases as defense attorneys
including indictments charging RICO, securities fraud, mail fraud,
health care fraud, anti-trust, money laundering, tax and Martin
Act violations. The following are brief descriptions of some of
our trials and some current matters:
Major Trials
United States v. Finnerty
- Client, a New York Stock Exchange Specialist, charged with securities fraud for allegedly trading ahead of customers on 40,000 trades. All charges dismissed after trial in Fedral Court, Manhattan on post-trial motions.
People v. Oates
- Client charged with perjury before the Grand Jury. Acquitted of all charges after trial in New York Supreme Court.
People v. Espada
- Client, a New York State Senator, was charged with illegally using funds from a not-for-profit corporation for his political campaign. Acquitted of all charges after trial in the Bronx, New York.
United States v. Ballori
- Client charged with political corruption. Acquitted of all charges after trial in Federal Court, Puerto Rico.
People v. Orlando
- Client, a union leader, charged with extortion for a strike, and falsifying business records. Acquitted of all charges after trial in New York Supreme Court.
United States v. Ingber
- Client, brother of public official, charged with corruption. Acquitted of all charges after trial in Federal Court, Manhattan.
United States v. Mangano
- Client charged with federal income tax violations. Acquitted of all charges after trial in Federal Court, New Jersey.
United States v. Kaplan
- Client, a lawyer, charged with engaging in a scheme to defraud insurance companies and obstruction of justice. On appeal the conviction on the scheme to defraud charges was reversed based on evidentiary objections and arguments made at trial.
United States v. Halloran
- Client charged with RICO and anti-trust violations in fifteen-month trial. On appeal we obtained a reversal of his conviction.
United States v. Weinstein
- Client, owner of a securities brokerage firm, charged with securities fraud and commercial bribery. Acquitted of securities fraud charges after trial in Federal Court, Manhattan.
United States v. Mangano
- Client charged with 68 counts of RICO, anti-trust violations, and extortion. After 7 month trial in Federal Court, Brooklyn, client acquitted of 66 of 68 counts.
Duke v. Air Line Pilots' Association
- Client, Air Line Pilot Association, charged with unfair labor practices. Major portion of verdict against client set aside after trial in Federal Court, Brooklyn.
Representative Current Matters
Accounting Fraud:
- We represent the former Vice President of Reinsurance of AIG who is charged with participating in a scheme to fraudulently inflate the company's reserves and thereby cause AIG to publish a fraudulent financial statement. We will be defending him at trial.
- We represent partners at accounting firms in connection with investigations by the United States Attorney's Office and the SEC.
- We represent the former Comptroller of a company in a SEC fraud case.
Tax Fraud:
- We represent the former CFO of KPMG in a pending criminal tax case for allegedly participating in what the government describes as the largest tax fraud in U.S. history, involving the sale of allegedly illegal tax shelters. We will be defending him at trial.
Securities Fraud:
- We represent a New York Stock Exchange Specialist in an SEC fraud case.
Mail Fraud:
- We represent individuals in various investigations involving allegations of kickbacks to employees or contractors.
Mutual Funds Market Timing:
- We represent former brokers who are alleged to have been engaged in market timing and are being sued by the NYSE and the New Jersey Attorney General's Office.
Consumer Fraud:
- We represent a Canadian Energy company under investigation for allegedly deceiving customers.
Construction Industry:
- We represent a construction industry executive and will be defending him at trial.
Disciplinary Matters:
- We represent attorneys and disbarred attorneys in confidential disciplinary proceedings.
